Legal Office

The Catholic Diocese of Maitland-Newcastle has an in-house Legal Team who provide legal advice and support to the Diocese, its’ agencies and schools. This includes representation and compliance with subpoenas, requests for records and support for compliance with any other Court Orders.

Subpoenas

The Legal Team accepts service of subpoenas on behalf of the Diocese of Maitland-Newcastle, its’ agencies and schools. The Legal Team will accept electronic service to legal@mn.catholic.org.au. This is the preferred method.

Please ensure subpoenas are issued naming the correct entity as follows:

The Trustees of the Roman Catholic Church for the Diocese of Maitland-Newcastle on behalf of (insert agency or school name).

Subpoenas for production of documents should not be issued to any individual person. In some circumstances documents may be held by a consultant rather than by the agency. If you are unsure please contact the individual or the Legal team.

Requests for Records

All requests for records for all agencies and schools of the Diocese should be directed to the Legal Team.

Requests for records can be for individuals or authorised representatives.

A valid request must include:

  • Name and date of birth of subject of request.
  • If you are representing the subject of the request, a signed authority.
  • A clear indication of what records you are requesting and from which agency or school.
  • Confirmation of whether the Diocese of Maitland-Newcastle or any of its agencies, are or will be defendants in legal proceedings involving the subject of the request.
  • A certified copy of identification of the subject of request. A ‘certified copy’ is a copy of an original document such as a passport, drivers’ licence or birth certificate. The document then must be viewed and certified by an authorised person such as a Justice of the Peace or a Solicitor.
